This website is operated by EVARAE.COM. Throughout the site, the terms “we”, “us” and “our” refer to EVARAE.COM. EVARAE.COM offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.

Any new features or tools which are added to the current store shall also be subject to the Terms of Service. You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

THE BOXING DAY SALE 

The Boxing Day Sale, 70% off offer is available from 26 November 2023, on selected fashion products on www.evarae.com and in the EVARAE flagships store in London, United Kingdom. This offer cannot be used in conjunction with other offers or discount codes. EVARAE reserves the right to amend these terms and conditions and/or to amend or cancel this offer at any time at its sole discretion.

All 70% off products are 'all sales are final' -  meaning the items are not accepted back for return or exchange. By purchasing from the 70% off sales items, you agree to the terms and conditions that the products cannot be returned for exchange or refund.

DISCOUNT CODES

Please note when using a discount code, the discount can only be applied if processed at the time of the order. Discounts are not valid to be claimed after the order is placed and we can't 'refund' a discount, due to payment processing systems and accounting. A 'discount' is not a 'refund'.

Please note for any orders that are returned with the intention to re-purchase with a discount, any free shipping, duties/taxes and processing fees will be deducted from your refund for the original order.

You code will still work on a future order but can't be claimed on a past one.

Discount codes can’t be used on Sale or in conjunction with other discount codes.

SHIPPING ADDRESS

When making a purchase please ensure that all shipping information is correctly completed and that a working telephone number is provided to avoid any delays. We match your address with the logistic partner system and verify it is correct.   

Once you have placed your order you will receive a confirmation email from us. We recommend you go over your order to check everything is correct.

Our delivery time starts from the moment an order is accepted. You will receive a confirmation email once your order has been shipped by our logistic partner with a tracking number.      

Please note we require a signature to deliver your order to the address on your order confirmation, please ensure someone is home or you may arrange another time to attempt delivery at this address. If you make any changes to the delivery or booking without contacting customer services (examples), change of delivery address, notes such as - 'leave on the front porch' or 'with the nearest neighbour', or choosing delivery without signature, we can't be responsible for lost items or misplaced deliveries.

As the customer you are responsible for following the tracking for your delivery and advising our logistic partner should you not be home. Please note EVARAE is not able to assist with tracking your parcel or delivery queries after it leaves our warehouse, as the customer you should contact our logistic partner with any concerns relating to your delivery.

In the event of a misplaced delivery, as the customer, you need to contact the logistic partner and ask for proof of delivery signature. Should the package not be located directly with our logistic partner by opening a trace request, please then inform EVARAE.

If there is any delivery issue it's the customer's responsibility to contact our logistic partner or us within 14 days of the expected delivery date to make sure we can open an investigation with our logistic partner. 

Any refused or cancelled orders after shipping, and orders that are left sitting over the returns allowance shall have any associated order costs removed from the return/refund.      

COURIER OR CUSTOMS DELAYS

Please note EVARAE cannot take any responsibility for delays made by couriers or customs. Once the package leaves our warehouse (on your selected service) there can occasionally be an unexpected delay. If you miss your delivery, the courier will attempt the delivery again the next day. By making a purchase you agree with these terms of sale.

FAULTY ITEMS

Any faulty items are to be advised on delivery. In circumstances where defects happen during wear, a full refund is allowed up to 4 weeks after the delivery date, providing full adequate evidence is given.

This does not include intentional damage, damage from sharp objects or incorrectly followed care & washing instructions.

At EVARAE's discretion if the time frame exceeds 4 weeks, the item may be valid for store credit or the option for EVARAE to fix the piece.

ONLINE STORE TERMS
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.
You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).
You must not transmit any worms or viruses or any code of a destructive nature.
A breach or violation of any of the Terms will result in an immediate termination of your Services.

We reserve the right to refuse service to anyone for any reason at any time.
